When pop singer Aaron Carter tragically passed away at age 34, his on-again, off-again fiancée moved her belongings out of the home they’d shared with their 11 month old son.  It’s not yet clear what he was worth at the time of his death, but what is clear is who will decide who gets what: not Aaron.  He died without a will, and in such cases, the state decides how your assets are divided.

As in most states, in California, since he wasn’t married, it’s his baby who will get the money, but since the baby can’t exactly buy himself milk or if he, as Aaron himself sung, wants candy, he’ll need someone to buy it for him. That’s another thing that goes into a will—who is the trustee for a fund if the beneficiary is a minor—which you cannot dictate from beyond the grave if you didn’t write a will.  Lesson: write a will so the state does not have to decide for you.
